In Part 2 of our demystifying injunctions webinar series we looked at freezing injunctions (or 'Mareva' injunctions, as they are also known).
Freezing injunctions are a powerful tool in litigation. They are a court order that claimants use to help identify and secure assets to enforce their claims against, thereby significantly increasing the prospects of recovery. Freezing injunctions often put claimants in a strong position to resolve their claim, given the onerous and potentially penal consequences of non-compliance.
In this webinar, Michael Rhode, Laura Pennells and James Lancaster were joined by Jeremy Richmond KC of Quadrant Chambers, who have all successfully obtained freezing injunctions many times in various different contexts. We looked at the concept of freezing injunctions, the circumstances when they are commonly required, when they can be obtained, the practicalities of obtaining such injunctions and what to do to challenge a freezing injunction as a respondent.
