Our intellectual property litigation team is a dedicated specialist resource advising on the full range of IP rights, including trade marks and passing off, copyright, design rights, database right, patents, and rights in confidential information and know-how, together with related expertise concerning advertising, media and 'competitor' disputes such as comparative advertising, false/misleading advertising and trade defamation-type claims.
Disputes frequently relate to more than one jurisdiction and we have good contacts and established working relationships with a range of overseas IP specialists, associates and the Interlaw network.
We represent clients in all IP dispute resolution tribunals, including the English High Court (Business and Property Courts, Patents Court and the Intellectual Property Enterprise Court), the UK and EU Intellectual Property Offices, and arbitration proceedings applicable specifically to domain name disputes or under individual Internet Service Providers' own dispute resolution mechanisms.
Our experience includes mediation of complex IP disputes and negotiating and drafting settlement agreements which include within them provisions granting IP licences and coexistence provisions governing rights to apply for and use IP rights.
We act for a diverse mix of clients, ranging from household names to SMEs and start ups, and ranging from manufacturing, to retail, to R&D, to service providers, in sectors such as oil & gas, consumer home and garden goods, fashion and jewellery, toiletries and perfumes, food manufacturing, and in services sectors such as leisure, financial and investment, architecture and construction, charities, local authorities and other governmental organisations.
