Issues with an assignment to an insurer (Dassault Aviation v Mitsui Sumitomo Insurance)28 April 2023
Our highly experienced team acts for an impressive number of local and global insurers and fully understands and appreciates the financial and regulatory challenges currently facing the sector. We pride ourselves on being able to provide bespoke legal services and innovative solutions.
We provide comprehensive, cross-class claims resolution and policy advice including mediation, arbitration and litigation. We have considerable experience in litigating cases across jurisdictions, through our offices and access to lawyers in over 150 cities worldwide through Interlaw - a global elite network of legal firms.
Our team handle both large scale, complex and high value claims, but also high volume low value claims – and flexible to meet your needs so we can adjust our case management and billing structures and processes accordingly.
With proven experience in hospitality, travel and tourism work - we advise on claims arising out of accidents abroad, acting for both Claimants and Defendants. Whilst many of the cases we deal with involve personal injury, we also provide advice on all matters relating to travel insurance including coverage issues, policy wording, disputes, subrogation matters, uninsured loss recovery and review of ‘off-panel’ solicitor requests to insurers. We cover hotels, sport, and any leisure activity.
Acting for a number of major players in the aerospace sector - we deal with claims stemming from catastrophic losses, defence of passenger and cargo claims under the international Convention regimes, delay, cancellation, denied boarding and disability claims under the EC regulations and policy wording disputes. We further advise airlines and airports in relation to coverage concerns and regulatory issues/emerging policy and have represented various parties at inquests and fatal accident inquiries.
With significant experience advising title indemnity and contingency insurers on development related property risks, such as rights to light, restrictive covenants and other easements, we act for an impressive client base. We believe that our rights to light insurance claims practice in particular is second to none. In all cases we are able to utilise our extensive experience acting for developers and claimants to insurers’ benefit, aiming always to resolve claims swiftly and appropriately.
Experienced in public liability and professional indemnity, we work with insurers providing advice on public liability claims in the UK and abroad, and are panel solicitors specialising in large and complex loss cases for major household insurers. The team have significant experience of handling both technically challenging multi-party disputes and lower value but equally complex claims against financial advisors, construction professionals (including disputes relating to "cladding"), engineers, surveyors and IT/emerging professionals.
Advising on health and social care /medical malpractice related matters, we act for care commissioners and providers in relation to personal injury and fatal accident claims. We have considerable experience in cases involving brain injury, paralysis and amputation, often resulting in settlements in excess of £1million. We also advise on inquest procedure, supporting providers and their insurers throughout the entire process, from the collation and disclosure of evidence and preparation of witness statements, to providing representation at the hearing and thereafter, assisting with any Coroner's report to prevent further deaths.
