Mixed use developments are often complex and require specialist legal advice to ensure their success - both in terms of construction delivery and in relation to long term use.
A distinguishing aspect of our practice is our extensive experience and expertise relevant to all types, and aspects of, mixed-use, and residential real estate, from site assembly and planning to delivery and sale or rental of units. Being involved from early stages ensures residential elements are appropriately structured, well managed and acceptable to lenders, creating an attractive end product for both purchasers and investors. Our clients include leading private and public residential developers, retail and commercial developers and leisure/hotel operators and we have knowledge of all types of mixed use schemes from the creation of whole new urban quarters to smaller luxury developments and those involving student accommodation, PRS and senior living.
The legal complexities of sites on which we advise can be challenging and we often advise on issues such as contaminated ground conditions and the provision of new or diverted infrastructure (such as roads, bridges or stations) to access them and to serve the new development. We have significant experience in negotiating with the Environment Agency, Network Rail, TfL, utilities companies and other statutory undertakers and advising on remediation contracts, engineering contracts, asset protection, build-over agreements and works licences. Our experience in these areas allows us to propose the optimum methods of structuring such developments to address the concerns and maximise the opportunities for those owning, managing and funding such developments.
